GENERAL TERMS & CONDITIONS

  1. Introduction

    a. These are General Terms & Conditions. Each promotion has a customised set of Terms & Conditions listed as part of each individual item promoted.
    b. By participating in individual promotions, you agree to be bound by the General Terms & Conditions as well as each individual promotion Terms & Conditions set out in the corresponding promotion, which constitutes a legally binding agreement between you and the promoter.
    c. Where applicable, the promotion permit numbers will be available under each promotion and will apply to the corresponding individual promotion.
    d. All decisions made by the promoter with respect to any aspect of each promotion are final, and no correspondence will be entered into.

  2. Entry
    a. All entries have an equal chance at winning the individual prize.
    b. Please refer to individual promotions set of Terms & Conditions for eligibility.
    c. All entries will be deemed to be received only when received by the promoter
    d. Each state within Australia has a different promotional $ value that may require a permit.
    e. Each promotion Terms & Conditions will advise the eligibility for different state entrants.
    f. If your reside in a state that is not included for a particular promotion, you will not be permitted to enter that draw. Furthermore, all states excluded from a particular draw will exclude those states from being displayed or selected during the checkout process, therefore excluding your chance to purchase in that draw.
    g. If you submit an entry, you warrant that you are an eligible entrant as set out in the Terms & Conditions for that corresponding draw. You may be disqualified from the promotion if you falsely state your residing state.
    The promoter reserves all rights with respect to such breach, to exclude your entry due to permit restrictions.
    h. From time to time, we may conduct free giveaways, promotions or competitions (including via livestreams). Entry into such promotions is always free and does not require any purchase.
    i. Unless otherwise specified, winners will be selected fairly at random that is clearly explained in each product set of Terms & Conditions.
    j. We will publish the name & photo of the winners on this website & our social media pages and ensure that all prizes are awarded as advertised.
    k. By participating, all entrants agree to these Terms & Conditions, together with each individual corresponding promotion Terms & Conditions provided at the time of each promotion.
    l. All promotion entrants must be residing in Australia and be at least 18 years old.
  3. PRIZES
    a. The prize must be accepted as offered and claimed in accordance with each promotion details, otherwise the prize shall be forfeited by the winner.
    b. The promoter will not be liable for any unclaimed prize(s) under this clause and the promoter is under no obligation to offer an additional or substitute prize to that winner.
    c. Unless otherwise stated, the prize cannot be redeemed for cash for any reason; or used for promoting or other commercial purposes.
    d. The total prize value is set out under each promotion. All details are correct as at the date of preparing the Terms & Conditions and shall include any applicable GST.
    e. The promoter does not accept any responsibility for a variation in the prize. If any prize (or part thereof) is unavailable, the promoter reserves the right to substitute the prize with a prize of equal or greater value and you agree to accept such substitution in writing, subject to any applicable regulation.
    f. The Promoter is not responsible for any dispute between a winner and any person(s) with whom a winner chooses to share the prize(s).
    g. The promoter is not responsible for any tax implications and the winner is solely responsible for the payment of all taxes (if any) in connection with the prize. It is the winner’s sole responsibility to seek independent financial advice as required.
  4. DRAW & WINNERS
    a. The promoter will conduct the prize draw via a government approved system:-www.randomdraws.com.au – which ensures the winner shall be selected at random.
    The winner will be notified via telephone and email within 48 hours of draw.
    b. The promoter may draw additional reserve entry winners in the draw and record them in order as reserve winners.
    In the event that:
    1. A winner is deemed ineligible for any reason.
    2. After the promoter makes reasonable efforts, the winner cannot be identified.
    3. Where a winner forfeits a prize, then the prize may be awarded to the reserve winner(s).
  5. PERSONAL INFORMATION
    a. Your personal information is directly collected by the promoter in connection with the promotion and is used to:
    1. Conduct and promote the promotion.
    2. Provide you with the promoter’s monthly subscription updates via email and SMS.
    3. The winner agrees to participate in promotional activity and consents to the use of the winner’s name and image in connection with the promotion, which will be publicised on the promoter’ website and social media pages.
  6. LIMITATION OF LIABILITY
    a. To the fullest extent permitted by law, the promoter is not liable for any personal injury or death, losses or damages of any kind to persons or property resulting from the participation in the promotion or from the acceptance, possession, misuse or use of any prize.
    b. The promoter and its partners, agents, suppliers of the prize, or associated companies are not liable for any incorrect or ineligible submission entries, failure to claim a prize, damage or delay in delivery of prizes, or failure to receive correspondence.
    c. If this promotion cannot be conducted for any reason beyond the promoter’s control (including but not limited to technical issues or failure or tampering and fraud), the promoter may end, amend, suspend or cancel the promotion or disqualify affected entries.
  7. SMS & EMAIL opt-in Terms
    a. By providing your mobile number and email address you consent to receive marketing and promotional material from Flash Rewards via SMS and email.
    Messages may include updates, special offers, or other information related to our products or services. Message frequency may vary. You can opt-out at any time by clicking the opt-out (SMS) link or unsubscribe (Email) link, or by contacting us directly.

  8. DONATIONS
    a. The promoter will donate a minimum of 10% of each prize pool to a registered Australian charity. The donation $ amount will be displayed in each promotion.
    The charity will be selected by the entrant on checkout from a list of charities.
    The list of charities will be determined by the promoter.
    b. If you wish to have a charity added to our list please email your request to info@flashreward.com.au
    All requests to add a charity will be managed and determined by the promoter.
  9. ONLINE STORE
    a. Our online store is available to all members of the public.
    You do not require membership to make a purchase from our online store.
    b. Some items purchased through our online store will be dispatched by the promoter and some items will be drop shipped directly from the supplier to the purchaser.
    c. All items purchased include delivery tracking.
    d. You must advise us immediately if any issues arise in either damaged or non-delivery of an item, so we can satisfactorily resolve the issue in a timely manner.
  10. ACCEPTANCE OF TERMS
    a. The Customer accepts and agrees to be bound by these General Terms and Conditions as well as each individual product Terms & Conditions by submitting an order to the seller for the supply of products and/or the by accepting products supplied by the seller.
  11. PAYMENT
    a. All prices listed on this site are in Australian dollars.
    b. The Seller reserves the right to make changes to prices, products, product availability, policies and terms at any given time.
    c. The Seller accepts the following payment methods: Credit/Debit Card and PayPal.
    All payments options are securely processed via the respective third-party gateway (Stripe & PayPal)
  12. RETURNS/REFUNDS
    a. The seller reserves the right to accept any cancellation of customer’s membership package.
    b. In order to be considered for a refund, the customer must request a cancellation/refund.
    c. The seller will notify the customer of the outcome request and refund any funds if applicable.
  13. GENERAL
    a. Nothing in these Terms & Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010.
  14. JURISDICTION
    a. These Terms and Conditions shall be governed by the laws of NSW.
    b. By entering the promotion, you accept that if any dispute may arise with respect to the promotion, shall be subject to the jurisdiction of the NSW Courts in Australia.

SUBSCRIPTION TERMS & CONDITIONS

  1. Introduction

1.1 These Subscription Terms & Conditions govern participation in the Flash Rewards VIP Club monthly subscription and prize draws.

1.2 By subscribing to and participating in any monthly subscription draw, you agree to be bound by these Subscription Terms & Conditions, the General Terms & Conditions, and any specific Promotion Terms & Conditions applicable to each draw.

1.3 All decisions made by the Promoter in relation to any aspect of a promotion are final and binding. No correspondence will be entered into.

  1. Eligibility

To become a member of the Flash Rewards VIP Club, you must:

  • Be at least 18 years of age;
  • Be a resident of Australia; and
  • Agree to comply with these Terms & Conditions.
  1. Membership Package – Monthly Subscription
  • Subscription Tiers: BRONZE $10.00 pm / SILVER $30 pm / GOLD $59 pm – billing cycle monthly.
  • Access to monthly VIP prize draw with prizes valued at $3,000.
  • Receive a 10% discount on products purchased from the Flash Rewards online store during your active membership.
  • Entry into draws with strictly limited prize pools, providing improved and clearly defined odds of winning.

Your subscription will automatically renew each month unless cancelled in accordance with these Terms.

  1. Draws & Winners

4.1 Prize draws will be conducted using a government-approved random draw system via www.randomdraws.com.au, ensuring winners are selected at random.

4.2 Winners will be notified by telephone and email within 48 hours of the draw.

4.3 The Promoter will publish the name & photo of the winners on this website & its social media pages and ensure that all prizes are awarded as advertised.

4.4 By participating, entrants agree to these Terms & Conditions and any additional Promotion Terms & Conditions applicable to each draw.

  1. Payment

7.1 All prices are listed in Australian Dollars (AUD).

7.2 The Promoter reserves the right to amend pricing, products, availability, policies, and terms at any time.

7.3 Accepted payment methods include Credit/Debit Card and PayPal.

7.4 Payments are securely processed via third-party payment gateways including Stripe and PayPal.

  1. Cancellation & Termination
  • You may cancel your subscription at any time via your account settings on the website.
  • Cancellation will take effect at the end of the current billing period.
  • No refunds will be provided for any unused portion of the subscription period, except as required by law.
  • Entries received during the active subscription period remain valid for the relevant draw.
  1. Limitation of Liability

9.1 To the fullest extent permitted by law, the Promoter is not liable for any personal injury, loss, or damage (including indirect or consequential loss) arising from participation in a promotion or the acceptance, possession, or use of any prize.

9.2 The Promoter and its partners, agents, suppliers, and associated companies are not responsible for:

  • Incorrect, incomplete, or ineligible entries;
  • Failure to claim a prize;
  • Delays, damage, or issues relating to prize delivery;
  • Technical errors, interruptions, tampering, or unauthorised interference.

9.3 If a promotion cannot be conducted as planned due to circumstances beyond the Promoter’s control, the Promoter reserves the right to amend, suspend, cancel, or terminate the promotion, subject to regulatory approval where required.

Nothing in these Terms & Conditions restricts, excludes, or modifies any consumer rights under the Competition and Consumer Act 2010 (Cth) or the Australian Consumer Law, which cannot be lawfully excluded.

  1. Jurisdiction

11.1 These Terms & Conditions are governed by the laws of New South Wales, Australia.

11.2 Any disputes arising in connection with a promotion or subscription are subject to the exclusive jurisdiction of the courts of New South Wales.
